1. Acceptance of Terms
By accessing or using the Obzor Cloud application and website (obzor.cloud) (the "Service"), operated by Desert Rose FZE ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, do not use the Service.
2. Description of Service
Obzor Cloud is a comprehensive business analytics and intelligence platform that provides:
- Video Analytics: Customer flow analysis, occupancy tracking, and operational insights
- Performance Monitoring: Staff efficiency metrics and service optimization
- Dashboard Access: Real-time analytics and historical reporting
- Multi-Industry Support: Suitable for retail, hospitality, office spaces, and other business environments

3. Business Accounts and Authorization
3.1 Account Registration
- You must be a legitimate business owner or authorized representative
- You must provide accurate business information including contact details and location
- Only authorized personnel may access the analytics dashboard
- You are responsible for maintaining the security of your account credentials
3.2 Account Responsibility
- You are solely responsible for all activity under your business account
- You must notify us immediately of any unauthorized access
- You must ensure all staff are aware of the analytics system installation
4. Camera Installation and Equipment
4.1 Hardware Ownership
Equipment Ownership: You own all camera hardware installed at your location. We provide software and analytics services only.
4.2 Installation Requirements
- Site Access: You must provide reasonable access for installation and maintenance
- Infrastructure: You must provide necessary power and network connectivity
- Compliance: Installation must comply with local building codes and regulations
- Existing Systems: We will work with compatible existing CCTV systems where possible
4.3 System Operation
Video Processing: Cameras transmit video footage to our servers for processing and analysis. All video processing occurs on our infrastructure.
5. Acceptable Use and Compliance
5.1 Permitted Uses
You may use the Service to:
- Monitor business operations and customer/visitor flow
- Optimize staff performance and operational efficiency
- Generate business intelligence reports
- Improve revenue and operational efficiency across various business types
5.2 Customer and Staff Notifications
Your Responsibilities:
- Customer/Visitor Consent: You are responsible for any required notifications about video analytics in your establishment
- Staff Notification: You must inform staff about performance monitoring systems
- Privacy Compliance: You must ensure compliance with local privacy and surveillance laws
- Regulatory Compliance: You must ensure our service complies with local business regulations
5.3 Prohibited Activities
You may not:
- Use the Service to identify or track specific individuals without proper legal basis
- Share analytics data with competitors without our consent
- Use the system for purposes other than legitimate business operations
- Interfere with or disrupt the Service or camera systems
- Attempt to reverse engineer our analytics algorithms
6. Data and Analytics
6.1 Data Ownership and Usage
- Your Data: You own your business operational data and analytics insights
- Confidentiality: Your analytics data remains confidential and is not shared with competitors
- Aggregated Data: We may use anonymized, aggregated data for service improvement
6.2 Data Processing and Security
- Server-Side Processing: Video footage is transmitted to and processed on our secure servers
- Encryption: All data is encrypted in transit and at rest
- Access Controls: Strict role-based access to your analytics data
6.3 Data Retention
Video Data Storage:
- Standard Retention: Video footage is stored on our servers for up to 6 months
- Technical Limitations: Due to infrastructure constraints, video data may be retained for up to 12 months
- Analytics Data: Processed analytics stored for the duration of your subscription plus 12 months
- Account Data: Retained for compliance and billing purposes
7. Service Availability and Performance
7.1 Service Level
- We strive for 99.5% uptime but make no absolute guarantees
- Service may be temporarily unavailable for maintenance
- Analytics processing may have delays during peak usage
7.2 Technical Support
- Installation Support: Provided during initial setup
- Technical Support: Available via [email protected]
- System Maintenance: Scheduled maintenance with advance notice
8. Subscription and Payment Terms
8.1 Subscription Plans
- Service is provided on a subscription basis
- Pricing is determined by your chosen plan and number of camera points
- Custom enterprise solutions available upon request
8.2 Payment Terms
- Fees are charged in advance for the subscription period
- Late payments may result in service suspension
- Price changes will be communicated 30 days in advance
8.3 Refund Policy
Limited Refund Policy:
- Eligible Refunds: Only the most recent payment is eligible for refund
- Calculation: Refund amount is calculated proportionally based on unused days in the billing period
- Example: If you paid for 1 month and cancel after 10 days, you receive a refund for the remaining 20 days
- Processing: Refunds processed within 5-10 business days of approval
8.4 Equipment and Installation
Installation Costs: Camera equipment and installation costs are separate from subscription fees and are detailed in your service agreement.
9. Intellectual Property
9.1 Our Intellectual Property
- The Obzor Cloud platform, software, and algorithms are owned by Desert Rose FZE
- "Obzor Cloud" and related marks are our trademarks
- You may not reverse engineer or copy our software
9.2 Your Business Data
- You retain ownership of your business operational data
- You grant us limited license to process data for analytics generation
- We do not claim ownership of your business insights or strategies
10. Privacy and Compliance
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference. You must ensure compliance with:
- UAE Data Protection Law
- Local privacy and surveillance regulations
- Industry-specific regulations applicable to your business
- Employee monitoring laws in your jurisdiction
11. Disclaimers and Limitation of Liability
11.1 Service Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
11.2 Analytics Accuracy
Analytics Disclaimer: While we strive for accuracy, analytics results are estimates and may not be 100% accurate. Business decisions should consider multiple data sources.
11.3 Limitation of Liability
WE ARE NOT RESPONSIBLE FOR:
- Business decisions made based on analytics data
- Revenue losses due to system downtime
- Camera hardware failures or damage
- Compliance violations related to customer/staff notification
- Data loss due to technical failures
- Indirect, incidental, or consequential damages
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF YOUR MOST RECENT MONTHLY PAYMENT.
12. Termination
12.1 Termination by You
- You may terminate with 30 days written notice
- You retain ownership of installed camera equipment
- Analytics data export available upon request
- Refund processed according to our refund policy if applicable
12.2 Termination by Us
We may terminate your account immediately for:
- Violation of these Terms
- Non-payment of fees
- Misuse of the analytics system
- Failure to comply with legal requirements
12.3 Effect of Termination
- Analytics dashboard access will be disabled
- Data retention according to our Privacy Policy
- Camera equipment remains your property
- Final billing reconciliation
13. International Operations
Obzor Cloud operates from the UAE and may process data internationally. We maintain consistent data protection standards across all operations.
14. Changes to Terms
We may modify these Terms with optional 30 days notice via email. Significant changes affecting service functionality may require your explicit consent.

Email notifications are provided as a courtesy only - you are solely responsible for regularly checking this page for the current version of these Terms. 15. Indemnification
You agree to indemnify Desert Rose FZE from claims arising from:
- Your use of the Service
- Failure to obtain required customer or staff consents
- Violation of privacy or surveillance laws
- Misuse of analytics data
16. Governing Law and Jurisdiction
These Terms are governed by UAE law. Disputes shall be resolved through arbitration in Dubai, UAE.
17. Force Majeure
We are not liable for service interruptions due to circumstances beyond our reasonable control, including natural disasters, government actions, or internet infrastructure failures.
18. Severability
If any provision is found unenforceable, the remaining provisions continue in full effect.
